Terms of Service

These Terms of Service ("Terms") govern the email authentication services ("Services") provided by Nicheline ("we", "us", "our") to the client ("you", "your"). By subscribing to a plan or paying an invoice, you agree to these Terms.
1 Services
We provide setup, configuration and ongoing monitoring of email authentication standards (including SPF, DKIM and DMARC) for the domain(s) you specify. The specific scope depends on the plan you select. Services are delivered remotely and in writing. We do not provide services by phone or live meeting unless separately agreed.
2 What we do and do not do
- We configure and monitor DNS records related to email authentication.
- We advise on changes and either provide records for you to apply, or apply them where you have granted us delegated access.
- We do not manage your wider IT, your email content, your mail server, or any systems beyond email authentication DNS records.
- We do not take ownership of your domain, your DNS account, or your email accounts.
3 Fees and billing
- Fees are as stated at the time of subscription, billed monthly in advance via our payment processor, unless a one-time service is agreed.
- Subscriptions renew automatically each month until cancelled.
- You may cancel at any time through the self-service portal or by email; cancellation stops future billing. Fees already paid are non-refundable except where required by law.
- One-time services are payable in advance and are non-recurring.
4 Your responsibilities
- You confirm you are authorised to request changes to the domain(s) you provide.
- You are responsible for the accuracy of information you give us, including which email senders are legitimate.
- Where you apply DNS records yourself, you are responsible for applying them correctly and promptly as instructed.
- Where you grant us delegated access, you are responsible for the scope of access you grant and for revoking it when the engagement ends.
- You will not ask us to perform anything unlawful, including sending unsolicited email in breach of applicable laws.
5 Access and security
- We will never ask for your account passwords. Access is provided either by you applying records yourself, or by delegated/limited access that you control.
- You may revoke our access at any time. Revoking access may prevent us from delivering the Services.
- We handle your data in line with our Privacy Notice.
6 No warranties
Email authentication reduces, but cannot entirely eliminate, the risk of spoofing, impersonation and deliverability problems. Email delivery depends on many third parties outside our control (mailbox providers, your sending tools, DNS providers, recipients' filters).
The Services are provided on a "best efforts" basis using recognised industry practices. We do not warrant or guarantee that:
- your domain will be completely protected against all spoofing or impersonation;
- all of your email will be delivered, or will never be marked as spam or rejected;
- any specific deliverability rate, inbox placement, or compliance outcome will be achieved.
To the extent permitted by law, all implied warranties are excluded.
7 Limitation of liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special or consequential damages, including lost profits, lost revenue, lost business, lost data, or reputational harm, arising from or related to the Services.
- Our total aggregate liability for any claim arising from or related to the Services is limited to the total fees you paid to us in the three (3) months immediately before the event giving rise to the claim.
- Nothing in these Terms excludes liability that cannot be excluded by law (for example, liability for fraud or for death or personal injury caused by negligence).
8 Third-party tools
We use third-party platforms (for example, a DMARC monitoring platform and a payment processor) to deliver the Services. Your use of the Services may be subject to those providers' own terms. We are not responsible for the acts, omissions or availability of third-party platforms.
9 Confidentiality
We keep your technical and business information confidential and use it only to deliver the Services. You keep any non-public information we share (including methods and reports) confidential.
10 Term and termination
- These Terms apply for as long as you use the Services.
- Either party may terminate a subscription at any time; termination takes effect at the end of the current paid period.
- We may suspend or terminate the Services if you breach these Terms, fail to pay, or ask us to do something unlawful.
- On termination, we stop monitoring and you are responsible for your domain's configuration thereafter.
11 Changes to these Terms
We may update these Terms. Material changes will be communicated by email or on our website. Continued use of the Services after changes take effect constitutes acceptance.
12 Governing law
These Terms are governed by the laws of Slovenia. The courts of Ljubljana have jurisdiction, subject to any mandatory consumer protections that apply to you.
