Terms of Service

These Terms of Service ("Terms") govern the email authentication services ("Services") provided by Nicheline ("we", "us", "our") to the client ("you", "your"). By subscribing to a plan or paying an invoice, you agree to these Terms.

1 Services

We provide setup, configuration and ongoing monitoring of email authentication standards (including SPF, DKIM and DMARC) for the domain(s) you specify. The specific scope depends on the plan you select. Services are delivered remotely and in writing. We do not provide services by phone or live meeting unless separately agreed.

Timelines we communicate (for example, an estimated eight to twelve week implementation) are indicative only. Progress depends on data collection periods, on your cooperation (applying records, confirming senders, granting access) and on third parties (DNS propagation, mailbox providers). Waiting periods are a normal part of the Services and do not suspend billing.

We aim to respond to your messages within one (1) business day. This is a service target, not a guaranteed service level, unless a specific response time is expressly included in your plan.

The Services depend on identifying every system that legitimately sends email for your domain(s). As part of the implementation we prepare an inventory of detected senders and ask you to review it.

You must confirm in writing (email is sufficient) which senders are legitimate. We are entitled to rely on your confirmation. We are not liable for the disruption, quarantining or rejection of email from any sender, tool or system that you did not disclose to us or did not confirm as legitimate when asked.

Changes that strengthen the enforcement policy of your domain are made only after your written approval (an email reply such as "go ahead" is sufficient). If you do not respond to a request for approval, your domain remains at its current protection stage; we are not liable for any consequences of the resulting delay, and billing continues in the ordinary course.

If our monitoring indicates that legitimate email may be affected after an enforcement change, we may relax the enforcement policy without your prior approval in order to protect your email flow, and will inform you promptly afterwards.

After implementation, you must inform us when you start using a new tool or service that sends email on behalf of your domain(s). We are not liable for delivery issues caused by senders added without notification, until they are reported to us or detected by our monitoring and subsequently authorised.

7 One-time services

Where you purchase a one-time service (for example, a one-time setup and handoff), the service consists of an initial analysis, the configuration of email authentication records up to the policy level agreed in writing, and written handover instructions. The service is completed on handover.

One-time services do not include monitoring, reporting or maintenance after handover. Email authentication is not a static configuration: it can degrade as you add or change email tools, senders or providers. After handover, you are solely responsible for the ongoing accuracy and maintenance of the configuration.

Any defects in a one-time service must be reported within fourteen (14) days of handover; we will correct reported defects at no additional charge. Our total aggregate liability arising from a one-time service is limited to the fee paid for that service.

8 No warranties

Email authentication reduces, but cannot entirely eliminate, the risk of spoofing, impersonation and deliverability problems. Email delivery depends on many third parties outside our control (mailbox providers, your sending tools, DNS providers, recipients' filters).

The Services are provided on a "best efforts" basis using recognised industry practices. We do not warrant or guarantee that:

10 Third-party tools

We use third-party platforms (for example, a DMARC monitoring platform and a payment processor) to deliver the Services. Your use of the Services may be subject to those providers' own terms. We are not responsible for the acts, omissions or availability of third-party platforms.

11 Confidentiality

We keep your technical and business information confidential and use it only to deliver the Services. You keep any non-public information we share (including methods and reports) confidential.

We may update these Terms. Material changes will be communicated by email or on our website. Continued use of the Services after changes take effect constitutes acceptance.

14 Governing law

These Terms are governed by the laws of Slovenia. The courts of Ljubljana have jurisdiction, subject to any mandatory consumer protections that apply to you.
